Agreement.
These Terms of Use form a contract between you and Superbigcompany LLC ("Given," "we," "us"). They govern your use of the marketing site at mygiven.app, the gift checkout, the waitlist, and the Given iOS app (together, the "Service"). By using the Service you agree to these terms. If you don't agree, please don't use the Service.
Eligibility.
The Given iOS app is rated 4+ in the App Store, but you must be at least 13 years old to create an account, buy a subscription, or send a gift (16 if you live in the European Economic Area or the United Kingdom). If you are under 18, you must have your parent or legal guardian's permission, and they must agree to these terms on your behalf. We do not knowingly collect personal information from children under those ages.
Your account.
The app requires an account to compute your saju and remember your readings. You are responsible for keeping your sign-in credentials secure and for everything that happens under your account. Tell us at hello@mygiven.app if you suspect unauthorized use.
License to use Given.
Given grants you a personal, limited, revocable, non-exclusive, non-transferable license to install and use the app on Apple devices you own or control, and to use the website, in each case for your own non-commercial use and in line with these terms. We keep all rights we don't grant you here.
Acceptable use.
You agree not to:
- break the law or anyone else's rights while using Given;
- scrape, mirror, reverse-engineer, or build a competing service from the app;
- upload another person's birth details without their genuine consent;
- use Given to harass, threaten, or defame anyone;
- interfere with the Service, our hosting, or other users.
Compatibility readings and other people's data.
Compatibility readings combine your chart with the chart of another person. By entering someone else's birth details, you confirm that you have their permission to do so. If they ask us to remove their information, we will. Don't enter charts for people who haven't agreed.
Subscriptions and in-app purchases.
Premium features in the app are sold through Apple's in-app purchase system as auto-renewing subscriptions. By subscribing you agree to the following:
- Term and price. The subscription length and price are shown in the app and on the App Store before you confirm the purchase. Prices may vary by region and may change; any change applies to renewals only after notice.
- Auto-renewal. Your subscription renews automatically at the end of each billing period unless you cancel at least 24 hours before the end of the current period. Your Apple ID account is charged on renewal.
- Cancel any time. You manage and cancel your subscription in your Apple ID Settings: Settings → [your name] → Subscriptions. Cancelling stops the next renewal; the current period continues until it ends.
- Free trials. If a free trial is offered, any unused portion is forfeited when you start a paid subscription.
- Refunds. Apple handles in-app purchase refunds. Request one at reportaproblem.apple.com.
Gift purchases on the website.
The gift checkout at mygiven.app is a one-time purchase processed through Stripe. It is not a subscription and does not auto-renew. If something goes wrong with your gift — wrong details, undelivered, or a duplicate charge — email hello@mygiven.app within 30 days of purchase and we will make it right, including a full refund where the gift has not been claimed.
Saju is for self-reflection.
Given is for self-reflection and entertainment. Your readings, your daily guidance, the answers from Ask, and any compatibility insights are interpretive. They are not, and are not a substitute for, professional medical, mental health, legal, financial, or other expert advice. Don't make a decision that matters by reading your chart alone — talk to a licensed professional.
Intellectual property.
The app, the site, the brand, the writing, the visual system, and the original interpretations are owned by Superbigcompany LLC and protected by copyright, trademark, and other laws. Saju itself is a living tradition; Given draws on the lineage of Park Jae-wan, Lee Seok-young, and Baek Young-gwan, and we credit those teachers with reverence. Nothing in these terms claims ownership of the tradition.
Disclaimers.
The Service is provided "as is" and "as available." To the fullest extent allowed by law, Given disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any specific reading will be true for you.
Limitation of liability.
To the fullest extent allowed by law, Given will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim arising out of these terms or the Service will not exceed the greater of one hundred US dollars or the amount you paid Given in the twelve months before the event giving rise to the claim.
Indemnification.
You agree to defend and indemnify Given and its officers, employees, and partners from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising out of your misuse of the Service, your breach of these terms, or your violation of someone else's rights.
Termination.
You can stop using Given at any time. Inside the app, Settings → Account → Delete account removes your account and your chart data per the privacy policy. We may suspend or end your access if you break these terms or use the Service in a way that puts other users or the Service at risk. Sections that by their nature should survive termination — IP, disclaimers, limitation of liability, indemnification, governing law, arbitration — survive.
Apple-specific terms.
The following terms apply to the Given iOS app downloaded from the Apple App Store. They are required by Apple, and where they conflict with anything else in these terms, they control for the app.
- Acknowledgement. These terms are between you and Given only, and not with Apple Inc. ("Apple"). Apple is not responsible for the app or its content. Your license to use the app is a non-transferable license to use it on an Apple-branded product that you own or control, and as permitted by the Usage Rules in the Apple Media Services Terms.
- Scope of license. The license is limited to use on Apple devices that you own or control. You may not redistribute the app or make it available over a network where it could be used by multiple devices at once.
- Maintenance and support. Given is solely responsible for providing any maintenance and support for the app. Apple has no obligation to furnish any maintenance or support services for the app.
- Warranty. Given is solely responsible for any product warranties, express or implied by law, to the extent not effectively disclaimed. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the app to you. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the app, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty are Given's sole responsibility.
- Product claims. Given, not Apple, is responsible for addressing any claims by you or a third party relating to the app or your possession or use of the app, including: (a) product liability claims; (b) any claim that the app fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection, privacy, or similar legislation, including in connection with the app's use of HealthKit or HomeKit (we don't use those, but the language is required).
- Intellectual property rights. If a third party claims that the app or your possession and use of the app infringes that third party's intellectual property rights, Given, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of that intellectual property infringement claim.
- Legal compliance. You represent and warrant that (a) you are not located in a country that is subject to a US Government embargo, or that has been designated by the US Government as a "terrorist supporting" country; and (b) you are not listed on any US Government list of prohibited or restricted parties.
- Developer name and address. Superbigcompany LLC, Brooklyn, NY, hello@mygiven.app.
- Third-party terms of agreement. You must comply with applicable third-party terms of agreement when using the app — for example, your wireless data service agreement.
- Third-party beneficiary. Apple and Apple's subsidiaries are third-party beneficiaries of these terms, and upon your acceptance of these terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these terms against you as a third-party beneficiary.
Governing law.
These terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. The federal and state courts located in Kings County, New York have exclusive jurisdiction for any matter not subject to arbitration below. The UN Convention on Contracts for the International Sale of Goods does not apply.
Arbitration and class action waiver.
Please read this section carefully. You and Given agree that any dispute arising out of or relating to these terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, and not in court. Arbitration is more informal than a lawsuit; an arbitrator can award the same individual relief a court can. You and Given waive the right to a jury trial and the right to participate in a class, collective, or representative action, to the extent permitted by law.
30-day opt-out. You can opt out of this arbitration agreement by emailing hello@mygiven.app with the subject line "Arbitration opt-out" within 30 days of first agreeing to these terms. Opting out does not affect the rest of these terms. Disputes about intellectual property and small-claims actions are excluded from arbitration.
Changes.
We may update these terms as Given evolves. When we do, we'll change the effective date at the top and, for material changes, give you notice in-app or by email at least 14 days before the change takes effect. If you keep using the Service after the change, you agree to the updated terms.
